The Tate brothers remain in police custody (final decision)

The Bucharest Court of Appeal decided on Monday, through a final decision, that the brothers Andrew and Tristan Tate remain in preventive detention. Thus, the decision of the Tribunal was maintained, according to the conclusion of the meeting. The magistrates also decided that Georgiana-Manuela Naghel and Alexandra-Luana Radu be pre-arrested, according to G4Media.ro.

According to DIICOT, the Tate brothers (with British citizenship) and the two young women constituted an organized criminal group, for the purpose of recruitment, accommodation and exploitation, by forcing some women to create materials with pornographic content, intended to be distributed for a fee on profile websites . He would have obtained important sums of money from these activities. The investigators claim that the Tate brothers recruited young women under the pretext of starting a love relationship, after which they took them to a house in Ilfov County, where they were forced to produce video clips, which were posted on websites for adults. The two brothers misled the young women that they wanted a marriage/cohabitation relationship and that they had real feelings of love for them (the 'loverboy' method).

The women were allegedly later transported and housed in a building in Ilfov county, where, through acts of physical violence and mental coercion (intimidation, constant surveillance, control and invoking alleged debts), they were sexually exploited by the group members by forcing to pornographic manifestations with a view to the production and dissemination, through social media platforms, of material having such a character and by submitting to the execution of a work, in a forced manner, in order to obtain important financial benefits consisting in the sums of money obtained as a result of accessing materials by users.

Based on art. 204 Criminal Procedure Code rejects as unfounded the appeal filed by the defendant TATE III EMORY ANDREW against the decision of 21.02.2023, pronounced by the judge of rights and liberties of the Bucharest Court – Criminal Section I in file no. 5135/3/2023.

Based on art. 275 para. 2 of the Criminal Procedure Code obliges the accused appellant to pay the sum of 500 lei, representing legal expenses advanced by the state.

Based on art. 204 of the Criminal Procedure Code admits appeals filed by

PUBLIC MINISTRY - The Prosecutor's Office next to the High Court of Cassation and Justice - Directorate for the Investigation of Organized Crime and Terrorism - Central Structure and by the defendant TATE TRISTAN against the conclusion of 21.02.2023, pronounced by the judge of rights and freedoms within Bucharest Court - First Criminal Section in file no. 5135/3/2023.

Abolish in part the challenged conclusion, regarding the defendants Tate Tristan, Naghel Georgiana-Manuela and Radu Alexandra-Luana, and re-judging:

Remove the provisions of art. 223 para. I letter a of the Criminal Procedure Code, considered as grounds for the extension of the measure of preventive arrest of the defendant Tate Tristan.

It maintains the provision of extending the preventive arrest of the defendant Tate Tristan, based on art. 223 para. 1 lit. b, c, para. 2 Criminal Procedure Code.

Based on art. 234 - art. 236 Criminal Procedure Code rap. to art. 223 para. 2 Criminal Procedure Code accepts the proposal to extend the measure of preventive arrest formulated by the Public Ministry - the Prosecutor's Office next to the High Court of Cassation and Justice - D.II.C.O.T. regarding the defendants Naghel Georgiana-Manuela and Radu Alexandra-Luana.

Orders the extension of the measure of preventive arrest of the NAGHEL defendants

GEORGIANA – MANUELA and RADU ALEXANDRA-LUANA for a period of 30 days, from 28.02.2023 to 29.03.2023, inclusive.

The solution is communicated to the administration of the place of detention.

Based on art. 275 para. 3 of the Criminal Procedure Code, the legal costs of the admitted appeals remain the responsibility of the state.

Based on art. 275 para. 6 of the Criminal Procedure Code, the legal expenses regarding the payment of the English interpreter's fee remain the responsibility of the state.
