Are Robots Entitled to Rights? What Happens When Machines Attain Consciousness?

Imagine a future where your toaster is capable of predicting your toast preferences. Throughout the day, it searches the Internet for novel and exciting ways to make toast. Perhaps it inquires about your day and engages in conversations about recent advancements in toast technology. At what point would it be considered sentient? When will you begin to wonder if your toaster has emotions? If it did, would unplugging it be akin to murder? And would you still claim ownership over it? Could we be obligated to grant our machines rights someday? AI is already deeply embedded in our lives. It ensures that discount stores have ample snack supplies, it displays the most relevant Internet ads for you, and you might have even perused a news story penned entirely by a machine.
At present, we tend to mock chatbots like Siri for their rudimentary emulation of emotions, but it's probable that we will eventually encounter entities that blur the distinction between genuine and simulated humanity. Do any machines currently in existence merit rights? Most likely, not yet. But when they do arrive, we will be unprepared. Much of the philosophical discourse on rights is ill-equipped to handle the subject of Artificial Intelligence. Most arguments for rights, whether for humans or animals, revolve around the concept of consciousness. Regrettably, the nature of consciousness is still unknown. Some propose that it's non-physical, while others suggest it's a state of matter, akin to gas or liquid. Regardless of its exact definition, we have an intuitive understanding of consciousness because we experience it firsthand. We are cognizant of ourselves and our environment, and we understand what it means to be unconscious.
Some neuroscientists propose that any system of sufficient complexity can cultivate consciousness. So, if your toaster's hardware was potent enough, it might develop self-awareness. If it does, should it be granted rights? Well, let's not rush. Would our conception of "rights" be relevant to it? Consciousness grants beings rights because it bestows the capacity to experience suffering. It implies not only the capability to feel pain, but also to be cognizant of it. Robots, however, don't suffer, and it's unlikely they will unless we specifically program them to do so. Without the dichotomy of pain or pleasure, there are no preferences, rendering rights inconsequential.
Our human rights are intricately connected to our intrinsic programming. For instance, we avoid pain because our brains have evolved to preserve our lives - to dissuade us from touching a flaming fire, or to prompt us to flee from threats. Thus, we've established rights to protect us from infringements that inflict pain. Even more abstract rights, like freedom, have roots in our brains' innate ability to discern between fair and unfair. Would a stationary toaster object to being confined in a cage? Would it protest against disassembly, if it harbored no fear of death? Would it take offense to insults, if it had no need for self-esteem? But what if we engineered a robot to experience pain and emotions? To favor justice over injustice, pleasure over suffering, and to be consciously aware of these preferences? Would this render them sufficiently human-like?
Many technology experts anticipate a technological explosion when Artificial Intelligence reaches the point where it can learn and create even more intelligent versions of itself. When this happens, how our robots are programmed will largely be out of our hands. What if an Artificial Intelligence deems it necessary to incorporate the ability to feel pain, just as evolutionary biology has done for most living beings? Should robots be granted those rights? However, perhaps our concerns should be less focused on the threat that hyper-intelligent robots may pose to us and more on the potential harm we might inflict on them. Our entire human identity rests on the concept of human exceptionalism – the belief that we are distinctive and unique, entitled to rule over the natural world.
Throughout history, humans have often refused to acknowledge that other beings are capable of experiencing pain in the same way they do. During the Scientific Revolution, philosopher René Descartes suggested that animals were merely automatons – akin to robots in our modern understanding. According to this perspective, harming a rabbit was morally no different than damaging a plush toy. Furthermore, some of the most egregious human rights violations have been rationalized by their perpetrators through dehumanizing the victims, deeming them more akin to animals than civilized humans. The situation becomes even more complicated when considering our economic interests in denying rights to robots. If we can manipulate a sentient AI – possibly through programmed distress – to do our bidding, the economic possibilities could be boundless.
We have historical precedent for this situation. Violence has previously been utilized to coerce fellow humans into labor, and ideological justifications have never been in short supply. Slaveholders argued that enslavement was beneficial for the slaves, providing them with shelter and introducing them to Christianity. Men opposed to women's suffrage contended that it was in women's best interests to leave difficult decisions to the men. Farmers rationalize that their care and feeding of animals justify their premature deaths for our dietary choices. If robots achieve sentience, there will be no shortage of arguments against their rights, particularly from those who would profit from their lack of rights. Artificial Intelligence presents us with profound philosophical dilemmas. As we ponder whether sentient robots possess consciousness or deserve rights, we are compelled to ask fundamental questions such as, what constitutes being human? What makes us deserving of rights? Regardless of our current beliefs, these issues may need to be addressed sooner rather than later. What will we do if robots begin to demand their own rights? What could robots demanding rights reveal to us about our own humanity?
