Brian coburger was back in a Layton County courtroom this afternoon where a judge heard arguments from his defense and the prosecution over several issues coburger is the man accused of murdering four University of Idaho students in a home just off campus in November of last year and just yesterday the prosecution filed their intent to seek the death penalty if a jury finds coburger guilty that's not the only issue that brought came up though NewsChannel 7's Morgan Romero was in court in Moscow this afternoon a shorter hearing than expected Morgan what did happen yeah well Doug they are originally supposed to address several issues but today's hearing was a lot quicker than we expected ended a lot sooner than we had anticipated and there was quite a bit of confusion in the courtroom they only took up one of the four issues that were on the calendar two motions to compel Discovery filed on behalf of the defense rather than all the other issues so the attorneys I'm told are working on these other things behind the scenes and those include a motion to release grand jury proceedings transcripts records materials as well as a motion to stay or pause proceedings a spokesperson with the Idaho judicial branch says It's Not Unusual for attorneys to work on this behind closed doors and do this sort of thing but the prosecution and the defense do disagree about whether or when certain records should be disclosed to the defense attorneys were also supposed to take up a third motion to compel Discovery I mentioned they talked about two motions to compel there is a third and that has to do with the defense wanting documents related to DNA and the genetic genealogy investigation that the FBI did that led them to Coburg but yesterday State asked for more time to respond to that ask and the judge granted it as for what was brought up in court today the defense wants training records of officers who did interviews with key Witnesses followed up on tips collected bits of evidence but the state says it's out of scope under Idaho rules and they won't call those officers to testify at trial they say it's not material to their case the judge says he'll consider arguments from both sides on this he'll look at case law and then make a decision coburger's defense attorney Ann Taylor is still asking prosecutors for investigative reports and conclusions from all cell phone analysis that was done by the FBI cast team to find the location of coburger's phone that information as we've previously reported was used in the probable cause affidavit to arrest co-burger and get several search warrants Taylor also wants reports from the FBI forensic examiner related to the change in the year of the white Hyundai Elantra that they were looking for in their search for the suspect she said prosecutors told her they'll give her some of that info but they don't know when so she asked the court to set a deadline and as the court is aware the state has violence you know death against Mr co-worker these are critical relevant materials all of them including the police training records they're necessary for us to prepare and present our defense of Mr co-worker they're necessary for us to do our investigation they're necessary for us to prepare our case and our motion practice moving forward these are things that we need to have there are the heightened standard now that the state has filed this notice of intent to seek debt and these are very relevant critical bits of information they are discoverable and we're asking the court to order the baby's applied to us so miss Taylor's correct she has everything that the state has in our profession and we'll work diligently and consistently in getting her all the information that we have and a today we have discovered approximately about 13 000 pages of reports 13 000 photographs over 2 000 tips and over 51 terabytes of audio video information yeah a lot of evidence the defense saying that they don't believe the prosecution is withholding this information they believe they are providing it as soon as they can but the judge did set a July 14th deadline for the federal government to provide all of that information there might not be hearings on those other issues we talked about the motion to release a grand jury transcripts and records as well as that motion to stay proceedings if attorneys can resolve all of these matters again as I mentioned behind closed doors rather than out in a public courtroom setting Doug and you mentioned also that that is not uncommon to do it that way correct yeah that's right Nate Pompano he's the spokesperson for the Idaho judicial branch I asked him that question he said it's not necessarily uncommon attorneys do this all the time and it was something that actually going into today's hearing after I'd reported that I thought it was going to take several hours was told by some people who are really in the know that they've seen over the last 20 Good evening from New York I'm Chris Hayes it is not often the case these days but today the Supreme Court issued a long anticipated Monumental ruling that actually bolsters America's Democratic strength now the case before the court today contained at its core an idea that was Central to the Donald Trump scheme to overturn the 2020 elections the question of whether State legislatures can do whatever they want in elections up to and including simply appointing electors to their preferred candidate even when the citizens of their state vote the other way Trump's lawyers pushed the idea that Republican legislators in all kinds of States could simply ignore the will of the people in states that voted for Joe Biden and opt instead to send their own fake electors Trump electors to Congress it was fake electors in seven swing States Arizona Georgia Michigan Pennsylvania New Mexico and Nevada that in coordination with the Trump campaign sought to overthrow the election results Trump and his lawyer John Eastman along with others actively lobbied for and pushed this idea across multiple states trying in fact to get state legislatures to abandon their Core Democratic Duty and choose instead a path to essentially Crown Trump King here's the former speaker the Arizona House Republican conservative Rusty Bowers describing a 2020 call he got from Trump coup lawyer John Eastman and what did uh Dr Eastman want you to do um that we would in fact vote take a vote to overthrow or I shouldn't say overthrow that we would decertify the electors and that that because we had plenary authority to do so I said what would you have me do and he said just do it and let the court sort it out plenary Authority Absolute Total Authority the state legislators have total Authority over who wins an election we now have new reporting from The Washington Post that special counsel Jack Smith has taken a keen interest in the fake electors plot focusing specifically on potential fraud New York Times recently reported that one of the Trump campaign's key players in the scheme may actually be cooperating with Federal prosecutors and tomorrow Republican Georgia Secretary of State Brad raffensberger who Trump infamously called and told to find roughly 11 000 votes to overturn the Georgia results we'll meet with Federal prosecutors for as far as we know the first time on the special counsel's team in Atlanta we're gonna have more on the special counsel's investigation and the rapid developments coming up but again at the core of Trump's attempted coup and there's a bunch of things going on but at its core as articulated by John Eastman as he told Rusty Bowers is this bizarre to my mind facially ludicrous Fringe idea that conservatives ran with after their scheme failed to return Trump to the White House it's called the independent state legislature Theory although calling it a theory gives it a little too much credit and it would give State legislatures plenerally virtually unchecked power over Federal elections it was an idea infamously pushed by coup memo author John Eastman and his allies in Congress basically says state legislatures are the ultimate Arbiters of how elections are run in a state no matter what state law or state officials or crucially state courts say all we are demanding of Vice President Pence is this afternoon at one o'clock he let the legislatures of the state look into this so we get to the bottom of it and the American people know whether we have control of the direction of our government or not [Applause] this is bigger than president trump it is the very essence of our Republican form of government and it has to be done and anybody that is not willing to stand up to do it does not deserve to be in the office it is that simple that was the speech at the ellipse right before an angry mob went to the Capitol and bashed a bunch of cops brains in the Insurrection on January 6 failed in its goal to subvert democracy it failed to keep Donald Trump in office for a second term but in many ways the spirit of the coup of Donald Trump's multi-plong plan to overturn the election results continued and continues I mean we've seen in state after State like Arizona Georgia and Texas Republicans stripping power from State elections officials and candidates vowing to abolish bipartisan election Commissions in States like Wisconsin so this time it wasn't a violent mob but politicians locally elected officials at the state level trying to carry out a version of Eastman's Vision right to take power back from any official that has it delegated and give it all to the state legislatures so that they can run elections entirely not coincidentally those are also the places where Republicans have a lot of control and they've been doing it right in front of all of us I mean we were covering it back in May of 2021 in Arizona Republican state legislators stripped Secretary of State Katie Hobbs a Democrat of her ability to defend election lawsuits and it gave the power to who well exclusively to the attorney general a republican we are watching essentially a slow-motion Insurrection being carried out by Republicans in suits and ties in States all across the country they are putting the pieces in place to do in the next elections what the mob failed to do on January 6th and that slow motion Insurrection this idea from the right wing that the power of self-governance does not sit in the hands of the people the idea that the power and oversight of Elections belongs to basically Republican self gerrymandered majorities in the state level that idea that core idea is the subject of today's Monumental Supreme Court ruling the cases out of the state of North Carolina it's called Moore V Harper and in it North Carolina Republicans argued that this independent state legislature Theory gave them virtually unchecked power over elections the lawmaker's argument hinges on a political concept called the independent state legislature Theory based on the Constitution's election Clause saying the time place and manner of holding elections for senators and representatives shall be prescribed in each state by the legislature thereof so if the court lands on the side of North Carolina House speaker Tim Moore and his Republican colleagues Fredrickson explains it could mean State legislatures can act independently and governors and state courts would have no ability to check laws related to federal election today in the 6th Street ruling the Supreme Court rejected that extreme extreme and dangerous legal Theory not to say one completely unfounded in the text of the Constitution the case centers are an extremely aggressive partisan North Carolina congressional map John bye Republican in this Republican state legislature very gerrymandered using 2020 census data and it's a map that would give Republicans up to 10 seats in the House in early 2022 the North Carolina Supreme Court threw out that gerrymandered map and rejected Republicans arguments that state courts had no role to play in drawing Congressional Maps and then conservatives tried to go over the state Court's head challenge the ruling on the cart and went to the Supreme Court to argue that the constitution gives them and only them us in the state legislature the only and total power over how we draw Congressional Maps state courts don't matter well today the conservative Supreme Court that Donald Trump is responsible for shaping plainly rejected this radical and dare I say it kooky notion Chief Justice John Roberts authored the six to three opinion with both Trump appointed justices Brett Kavanaugh and Amy Coney Barrett siding with the Liberals Justice Clarence Thomas samuelito Neil Gorsuch dissented in his opinion for the majority chief justice wrote that quote legislatures the framers recognized are the mere creatures of the state constitutions and cannot be greater than their creators meaning the state government as a whole functions to oversee elections if there's a state constitution that's interpreted by state courts they get a say State legislatures aren't some like special magical power that overrules everything in the state that's ludicrous this is the second pro-democracy ruling from this very right-wing Court this term alone remember a few weeks ago they also upheld crucially section two of the Voting Rights Act and struck down a flagrantly biased Alabama Congressional map and I can't read the minds of the justices particularly Roberts and Kavanaugh who are the majority of both opinions but I have to think the sustained Focus amongst the press and civil society and politicians on the very real indeed existential threats the American experiment as posed by John Eastman Donald Trump and his movement the focus on that has shaped the Court's thinking and thank goodness for that thank you

For those of you following Diablo 4 blizzard just dropped a major patch increasing experience on some of the dungeons as well as balancing changes to the game we're going to go through those there's a ton of bug fixes as well which I won't be going through all of those just know that there are a lot of bugs being fixed but we'll get into the experience adjustments and balancing changes and I'll also have the bug fixes up on the screen so if you want to read through them all you can so first of all significantly increase the Experience Awards for completing nightmare Dungeons and significantly increase the experience gained from killing monsters and Nightmare dungeons so if you were someone who was farming regular dungeons to get experience because it was faster now you have more incentive to do nightmare dungeons this is something they talked about in their fireside chat this was implemented really really quickly so that's a good change additionally heltai chess now provides substantially more bonus experience when open so if you want more experience from Hell Tides you're going to get that now and they significantly increase the rewards experience from completing individual Whispers across the board so you're gonna get more experience from doing Whispers quests another change here the hellside roaming bosses will now consistently drop higher quality loot I have not gotten a single legendary from these bosses so that's a great change and now players can teleport to their nightmare dungeon directly through the map and weekly bonus catches from the world boss no longer have a level requirement for opening that teleportation is huge some of the dungeons I simply refuse to do for nightmares because of how far away they are that really opens them up and being able to open these caches is going to free up storage space we all know how valuable storage space is moving to balancing changes let's take a look at Barbarian first firstly launching strikes base damage has been increased from 30 to 33 percent and the fury generated has been increased from nine to ten so that's a buff for them bash is furious generated has been increased from 10 to 11 and enhanced bashes fortify has been increased from 10 to 20 and frenzy's base damage has been increased from 20 to 22 percent so those are all Buffs for them right there the latest had its bleeding base damage increase from 36 to 40 percent Fury generated from 9 to 10 and enhanced Place vulnerable chance from 10 to 4 15 and double swings base damage has now been increased from 36 to 40 so all the basic skills for Barb have been bought kicks had its cooldown reduced from 17 to 13 seconds and base damage dealt to enemies knock back and train up from 54 to 7 percent that's a big buff for kick charges had its enhanced charge base damage dealt to enemies knock back and train increased from 15 to 30 percent and leaps Mighty leap slow has been increased from 50 to 70 percent so those have all been buffed as well iron skin has had enhanced iron skins barrier increased from 10 percent to twenty percent of your max life so that's a much better bubble now and quality ancients has had crime called the Ancients bonus attacks being increased from 10 to 20 percent so these are all Buffs still for Barb iron Maidstone has had its cooldown reduced from 60 to 45 seconds Prime Iron maze films bonus Critical Strike chance from 10 to 30 percent and Prime Iron males from bonacle Critical Strike damage from 20 to 40 percent and bounding slam has had its face damage increased from 75 to 112 so so far Buffs across the board for barbarian not a single Nerf moving across the legendary aspects for Barb bull cathos aspects had its damage buff earthquakes had its damage buff dust devils had its damage Buff when Lasher has had its damage buff devilish has had its damage buff iron Warriors had its damage buff and overkills had its damage increased and Hell Hammer has had its damage increase so all legendary aspects for barbarian have been bought moving along to Druid all of the basic skills except storm strike have been buffed having their damage increased as well as their Spirit generation increase and other chances for other things to happen like wild claws double strike attack increased from 10 to 15 so basically Buffs all across the board here for Druid except to storm strike lightning storm has had its enhanced lightning storm duration increase from four to six seconds meaning that you can keep up Max lightning past tasks for longer in between casts which is fantastic and Primal lighting Source chance to immobilize has been increased from eight to twelve percent which means that you're going to mobilize enemies more easily and you have a lot more increased damage to mobilized enemies as a lightning Druid so that's great shred has had its third Attack Base damage increased its enhanced shred healing from one to two percent maximum life which is huge radius base damage has been increased and Primal shreds critical damage has been increased from 20 to 30 percent so Buffs all across the board on shred so if you're playing a werewolf that's great news for you moving to wolves the cooldown's been reduced from 14 to 11 seconds and ferocious wolf packs lucky hit chance has been increased to 40 which is huge hurricanes had its base damage increase from 97.5 to 134 that's a huge buff rabies has had its base poisoning damage increased to 76 from 53 that's another huge buff cataclysm's base damage has been increased from 52 to 64 that's a minor buff cataclysm is already pretty strong lacerate space damage was increased from 400 to 460 so that's a small bot there petrified Critical Strike damage bonus to increase to 25 from 25 to 30 percent that's a small boost there and Pummel has had its base damage increase from 140 to 180 bonuses on the passives bistro Rampages had its attack speed bonus increase to 25 in damage bonuses to 30 I think that's because most people are not playing like werewolf wear bear hybrid builds let's try it and it just you know entice people to do that Nature's Fury got a buff here the chance to cast a free spell increase from 20 to 30 that's huge this was already easy to make use of with the aspect that you know gives you cool down when you proc this that's going to be even stronger now so if you're playing a Nature's Fury build it's gonna be even more strong Lupine ferocity has had its damage bonus increase from 60 on guaranteed crit to 70 so if you're playing a werewolf again this is a boost to you runeworkers conduit set its flat damage increased it's by from 1 to 1.4 so that's a 40 increase that's huge mangled has had its chance increase from 20 to 30 to 30 to 40 that's also a good change seismic shift this had its cooldown decreased from 2.5 to 1.5 from 2 to 1 and blurred Beast has had its damage increase from 60 to 90 to 70 100. so more Buffs for werewolf more Buffs for lightning here and Earth as well so again not a single Nerf to any of the classes here and just Buffs across the board moving to Necromancer the reap skills had its base damage increased and acolytes reached to cool down between corpses has been reduced from five to four that's huge if you're playing any sort of melee necro build or one that uses acolytes Reef to generate a corpse for like corpse tendrils or something like that decomposes had its base damage increased gent Essence generated increased corpse form frequency down from 2.5 to 2 seconds so that's good across the board Hammer just had its base damage slightly creased and Essence generated slightly increased bone splinters at base damage increased Essence generates increased so just like other classes pretty much all basic skills on necro buffed uh so this is Bluffs across the board moving to the core skills Sever's had its initial base damage slightly increased and its return damage buff from 25 to 40 that's a lot so if you're playing the Grim Reaper build I just put out that's going to be stronger bloodlance has had Supernatural bloodlands overpower requirements reduced from eight to six pass this means you're gonna overpower a lot more frequently that's huge for bloodlands because you really depend on that to get damage bone prison has had its cooldown reduced from 20 to 18 seconds and Dreadful bone prisons fortify has been increased by three percent iron maidens had its base damage increase to 20 that is a hundred percent increase and Horn I horde iron maiden's damage bonus has been increased from 15 to 20 so that's pretty good on our main it definitely needed about Corp Central's blight corpse General's chance to spawn a blood orb has been increased from 30 to 35 most people use the other upgrade for the vulnerable so I guess they're trying to entice people to use that here and Bone spikes's base damage has been increased from 80 to 120 Rey's skeleton and Golems minions will now always engage targets with a cast curse I'm assuming that means that if you cast a curse spell on an enemy minions will engage those targets so you can help better direct them that gives you a lot more reason to use a curse and build so like decrepifying Iron Maiden and probably become Staples at any mini build now from when it comes to passives kalon's edict makes it so damage taken during requirement reduced from three to two seconds this is the Keystone passive for minions which made it so that they would attack faster if you hadn't been damaged in three seconds this is down to two seconds it's really hard on the upper nightmare dungeons to not be damaged for a long period of time so I think they're trying to get people to use this by lowering it I'm still not sure people are going to use it though rothmus Vigor was also buff the duration you need to be healthy in order to overpower has been reduced from 15 to 12 seconds so if you're playing a blood necro right now you're gonna be a lot stronger than you were before Spike armors Thorne's values have been increased by a little bit so if you're playing a Thorns neck row something like razor plate you're gonna be in better shape than you were before actually give you a reason to maybe take Spike armor moving to Legendary aspects bursting bone aspects the flat damage has been increased on this by almost double actually exactly double so that's huge flesh rending the essence gained increase from 10 to 20 to 20 to 40. I think this is the one for blood orbs when you pick them up they give you Essence that's a huge amount because that's a blood necro unless you're playing blood surge you're typically not moving into these during combat if you are outside of combat so that's great and fast blood the ultimate cooldown reduction increased from five to one to 1.5 when you take up a blood orb so you might actually be able to like seriously generate ultimate and create ultimates very regularly with these upgrades Rogue is next invigorating strikes had its base damage increased blade shift base damage increased heart singer base damage increased and primary Heights hard Seeker damage increase from 30 to 75 percent that's a huge buff forceful's arrows base damage increased so basically all base skills except for puncture increase because everyone uses puncture barrage has had his base damage increase from 20 22 percent that's fantastic working on a barrage build right now caltrops has had its chill increase from 20 to 25 percent making the cold version you know able to freeze enemies like in four seconds instead of five that's fantastic smoke grenades had its cooldown reduced from 15 to 13 seconds this is also really good this is a really good skill a lot of people are sleeping on the scale I think Arena veros has had its cooldown reduced from 60 to 55 seconds and primary potency has been increased from 20 to 30 I love reign of arrows I'm glad to see this that just makes it so much better Folly has had its base damage increase from 70 to 105 percent uh when it comes to passes Close Quarters combats damage bonus has been increased from 20 to 30 percent so there is a couple Buffs across the board here I mean again there's no Nerfs here everything's Buffs and I would say Rogue got buffed probably much less than necro did but still good Buffs nonetheless Rogue is one of those classes my opinion that's already in a pretty good place it doesn't really matter what core skill you do you can play really well with all of them so seeing that they didn't get too many Buffs here I think it's probably good I'm still surprised we haven't seen a single Nerf yet moving along to sorcerer we have skills that are buffed first we have Sparks base damage increased enhanced damage increase flickering spark chance increase Frost bolts damage increase Fireball damage increase charging bolts damage increase so across the board here uh Buffs on all the basic skills also incinerates base damage has been increased the enhanced incinerates damage increased greater instant rate immobilized requirement reduced to three seconds from four that's huge Fireballs Mana cost has been reduced to 35 making fire builds a lot more viable than using Fireball since they typically struggle with Mana costs Frozen orb has had its damage increased to 32 to 36 percent its base damage on explosion has been increased from 29 to 34 and the greater orb Frozen orb chance to apply vulnerable has been increased from 25 to 30. so buff on Frozen orb Blizzard's damage has been increased ice Blade's chance to apply vulnerable has been increased Lightning Spear summoning a lightning Spear's maximum damage bonus increase from 100 to 160 percent crackling energies base damage increased and freezing wake space damage has been increased from 60 to 110 so again Buffs all across the board for sorks particularly in the ice area and a bit in the fire area not as much in the lightning area but a little bit there as well for legendary aspects abundant energy chance to chain an additional enemy has been increased from 20 to 30 to 30 to 40. singed extremities the slow amount has been increased from 25 to 35 to 40 to 60. so that's a huge increase on slow incendiary's chance to restore Mana has been increased from five to ten percent to 12 to 17. that's huge again anything for mana on sorks is great snow guard's damage reduction has been increased from 10 to 15 to 20 25 that's huge concentrations manually regeneration increased from 10 to 20 to 20 or 30 again that's also huge and when it comes to unique items flame scars had its flat damage increased from 0.1 to 0.2 to 0.2 to 0.3 so that's a 50 increase and staff of lamb Essence had the damage reduction reduced from 40 to 30 to 35 to 25 that's actually a buff so all Buffs again sork had 100 Buffs every single class has had Buffs there is not a single Nerf on the list so there are other miscellaneous fixes in this patch tons of them in fact I'm not going to go through them all this would be a 50 minute video but they're mostly bug fixes for quests mostly public fixes for dungeons things like that so if you want to read through that you can by all means but this is the gist of it the shocking thing here to me is its Buffs across the board clearly you know blizzard heard people's feedback from the fireside chat the other day and they didn't just Nerf what was strong but instead buff what wasn't so I hope this is the start of many such patches I still feel like some of these classes might need a little bit more tweaks but it's a good start I mean you don't want them to go so crazy that then they have to like
