Donald Trump

The beginning of the reckoning

By laraPublished 2 years ago 3 min read

Donald Trump's legal woes have deepened as a New York judge has ruled that he "repeatedly" misrepresented his wealth by hundreds of millions of dollars to banks and insurers. This decision marks a significant development in the civil lawsuit filed by New York's attorney general, Letitia James, against the former president. The judge's ruling resolves a critical claim made in this lawsuit, which alleges that Trump and his associates, including his two adult sons and the Trump Organization, provided false information about his net worth and asset values between 2011 and 2021.

The judge's decision, delivered by Justice Arthur Engoron of the New York state court in Manhattan, states, "The documents here clearly contain fraudulent valuations that defendants used in business." This verdict comes as a major setback for Donald Trump, just days before the trial was set to begin. In response to the ruling, an attorney for Trump labeled it "a miscarriage of justice."

Attorney General Letitia James initiated the lawsuit against Trump in September of the previous year. Her accusations revolve around the claim that the defendants engaged in a pattern of issuing false business records and financial statements. They allegedly did this to secure more favorable terms on bank loans, insurance agreements, and to reduce their tax obligations.

As the case proceeds to trial, Letitia James will be seeking $250 million in penalties and a ban on Donald Trump conducting business within his home state of New York. The trial, which is scheduled to commence on October 2nd, is expected to last at least until December.

The legal dispute between Trump and the New York attorney general centers on a variety of financial matters, including allegations of fraudulent business practices. In a pre-trial phase known as summary judgment, Letitia James requested that the court rule on certain undisputed facts to expedite the trial process. Conversely, Trump's defense team attempted to have the lawsuit dismissed, arguing that the public had not suffered harm as a result of his actions, and that the relevant loans dated back many years.

Donald Trump has consistently denied any wrongdoing in this case and has characterized it as yet another instance of political bias against him. In a statement, he dismissed the New York lawsuit as a "witch hunt" and accused the judge of being "highly politicized." Trump's legal team argued that the judge's decision ignored "basic legal, accounting, and business principles."

In addition to the financial penalties and business restrictions sought by Letitia James, the court's decision also ordered the Trump Organization to cancel its New York business licenses. This ruling, while not dissolving Trump's company, could potentially curtail his control over prominent New York properties, including the Trump Tower and the Trump Building at 40 Wall Street.

Furthermore, Judge Engoron rejected Trump's request to dismiss the case and imposed fines of $7,500 each on five of Trump's attorneys for making arguments that had already been rejected by the court.

During the court proceedings, a lawyer from Letitia James' office asserted that Donald Trump had endorsed statements that exaggerated the valuations provided by appraisers hired by his company. In contrast, Trump's attorney, Christopher Kise, argued that Trump's actions demonstrated his prowess as an "investment genius" who could identify value where others could not.

However, Justice Engoron's summary judgment affirmed that Trump's conduct went beyond mere self-promotion and that he and his organization had engaged in repeated deception regarding his financial matters. The judge cited specific instances where Trump had inflated the value of his assets, such as Mar-a-Lago, which was overvalued by 2,300% in one financial statement. Additionally, Trump had claimed that his penthouse at Trump Tower in New York was three times its actual size. The judge deemed such claims "absurd" and found that the discrepancies amounted to fraud.

Despite this setback, Donald Trump is still attempting to delay the trial in New York and has filed a lawsuit against the judge overseeing the case. An appeals court is expected to rule on this matter shortly, and if it rules against Trump, the case will proceed to trial.

This legal battle is just one of several that Trump is embroiled in as he campaigns for a potential rematch with President Joe Biden in the upcoming election. Despite facing 91 felony charges across four criminal cases, Trump has maintained his innocence in these matters. Nonetheless, these legal challenges add complexity to his political aspirations and continue to shape his post-presidential legacy.
