Social Security Disability Hearing Wait Times

Why does it take so long?

By Jason BarilPublished 3 years ago 3 min read

Social security disability benefits are designed to provide financial support to those who are unable to work due to a disability. However, the process of applying for these benefits can be long and daunting, especially when you consider the wait times for a hearing after initial denial. In this blog post, we'll explore what social security disability is, how the application process works, and why wait times for a hearing can be so long. Before you ever get to a hearing Social Security will have already stamped your claim denied two times.

What is Social Security Disability?

Social Security Disability Insurance (SSDI) is a federal program that provides financial support to individuals who are unable to work because of a disability. In order to qualify for SSDI, you must have a disability that is expected to last at least one year or result in death. Additionally, you must have worked and paid into the Social Security system for five out of the last ten years before becoming disabled or you will have to try to get Social Security Supplemental Insurance (SSI), which is an entitlement program and income based.

How Does the Application Process Work?

The application process for SSDI can be complicated and time-consuming. To apply for benefits, you must submit a claim to the Social Security Administration (SSA). The SSA will then review your claim to determine if you meet the eligibility requirements for SSDI. If your claim is denied, you have the right to appeal the decision and request a hearing. I recommend hiring a lawyer before you apply so that it minimizes something adverse being accidently put in the application by the applicant and the wording your lawyer uses may get the Claimant approved that much faster.

Why Are Wait Times for a Hearing So Long?

Unfortunately, wait times for a hearing can be quite long. In some cases, it can take up to two years or more to get a hearing after your initial claim has been denied. There are several reasons why wait times can be so long. One reason is that there is a backlog of cases waiting to be heard. Additionally, there is a shortage of administrative law judges to hear cases, which contributes to longer wait times. Further, you must be denied twice just to be able to get in the line with the judge and depending on the state that line might be very long.

What Can You Do to Expedite the Process?

While there is no guarantee that you can expedite the process, there are a few things you can do to help speed things up. One thing you can do is to make sure that you have all of the necessary documentation and medical records to support your claim. Additionally, you can enlist the help of a social security disability attorney who can guide you through the process and help you prepare for your hearing. Remember it does not have to be me but please hire a lawyer, alot of money is at stake and you are going up against a decent foe the federal government.

The wait times for a social security disability hearing can be long, but don't let that discourage you from pursuing the benefits you deserve and that are yours. Remember you paid into this system. By understanding the process and taking steps to prepare yourself, you can increase your chances of a successful outcome. If you have any questions or need assistance with your claim, don't hesitate to reach out to a social security disability attorney who can help you navigate the system.
